Jakarta – Dewan Perwakilan Rakyat (DPR) menggelar rapat tertutup dengan sejumlah pemangku kepentingan untuk membahas putusan Mahkamah Konstitusi yang mengamanatkan pemisahan pemilihan umum di tingkat nasional dan daerah. Wakil Ketua Komisi Bidang Pemerintahan Dede Macan Yusuf mengatakan rapat itu diarahkan langsung oleh pimpinan DPR dalam rangka konsultasi akomodasi putusan MK Nomor 135/PUU-XXII/2024.
Pertemuan itu dihadiri oleh pimpinan Komisi III DPR, pimpinan Badan Legislasi, Menteri Hukum dan HAM, Menteri Sekretaris Negara, Menteri Dalam Negeri, Komisi Pemilihan Umum (KPU) hingga Perkumpulan untuk Pemilu dan Demokrasi (Perludem).
“Kami membahas dari berbagai peninjauan, termasuk sumber-sumber gugatan yang diajukan oleh koalisi sipil masyarakat,” kata Dede saat ditemui di Kompleks Parlemen, Jakarta, pada Senin, 30 Juni 2025.
Politikus Partai Demokrat itu menceritakan bahwa pertemuan perdana tersebut masih dalam tahap awal penjaringan pendapat. “Ada beberapa hal yang cukup panjang kami perdebatkan, dalam konteks ini yaitu bahwa pemisahan ini kan sebetulnya adalah keputusan MK tahun 2019, yang artinya keputusan itu sudah final and binding. Sekarang diminta juga pemisahan Dewan Perwakikan Rakyat Daerah (DPRD),” tuturnya.
Sejauh ini Dede melihat bahwa putusan MK akan diakomodasi dengan perpanjangan masa jabatan kepala daerah dan DPRD dalam jangka waktu 2 hingga 2,5 tahun. Akibatnya itu akan mengubah sejumlah undang-undang lain. Dede menyebut putusan MK akan merombak Udang-Undang Pemerintahan Daerah, Undang-Undang Otonomi Khusus, hingga Undang-Undang Partai Politik.
Menurut Dede, perubahan yang kompleks ini menjadi perhatian bagi partai politik, DPR, dan kementerian atau lembaga teknis. “Oleh karena itu, tadi kami bersepakati masing-masing komisi akan melakukan kajian akademiknya dulu, nanti kajian akademik diserahkan dalam pertemuan selanjutnya di rapat konsultasi bersama pimpinan DPR dengan berbagai lembaga,” ujarnya.
Sehingga saat ini, Dede menyatakan, bahwa DPR bersama Badan Keahlian Dewan akan membuat kajian akademik terlebih dahulu untuk mencermati putusan MK.
Pada Kamis, 26 Juni 2025, MK memutuskan penyelenggaraan pemilu di tingkat nasional harus dilakukan terpisah dengan penyelenggaraan pemilu tingkat daerah atau kota (pemilu lokal). MK memutuskan pemilu lokal diselenggarakan paling singkat 2 tahun atau paling lama 2,5 tahun setelah pemilu nasional.
Pemilu nasional adalah pemilu anggota DPR, DPD, dan presiden dan wakil presiden, sementara pemilu lokal terdiri atas pemilu anggota DPRD provinsi/kabupaten/kota serta pemilihan kepala dan wakil kepala daerah.
Dengan putusan itu, pemilu serentak yang selama ini dikenal sebagai “Pemilu 5 kotak” tidak lagi berlaku untuk Pemilu 2029. “Penentuan keserentakan tersebut untuk mewujudkan pemilu berkualitas serta memperhitungkan kemudahan dan kesederhanaan bagi pemilih dalam melaksanakan hak memilih sebagai wujud pelaksanaan kedaulatan rakyat,” ujar Ketua MK Suhartoyo saat membacakan putusan.
Dalam pertimbangannya, MK menyatakan pemilu nasional yang berdekatan dengan pemilu lokal menyebabkan minimnya waktu bagi masyarakat menilai kinerja pemerintahan dalam hasil pemilu nasional. Dalam rentang waktu yang sempit itu, hakim menilai pelaksanaan pemilu yang serentak menyebabkan masalah pembangunan daerah cenderung tenggelam di tengah isu nasional.
